‘When is a pothole not a pothole?’ - Cllr. Swann

LOCAL councillor Roderick Swann has once again expressed astonishment at the response of Roads Service regarding compensation for drivers over potholes.

Cllr. Swann said he was disappointed with the fact that compensation to drivers for damage to tyres due to pot holes is dependent on the size of the pothole and a “priority to save costs rather than facing up to its responsibility to road users”.

He said: “To say that damage caused by a pothole of a certain size does not merit compensation is ludicrous.

“Drivers cannot miss potholes in inclement weather, nor stop and assess a pothole to see if they have to drive round it which obviously can’t be done.

“A damaged tyre is a damaged tyre and costs of repair are the same no matter what.

“Why should a person who suffers damage and decides to go to court with all the resultant costs be told that the pothole doesn’t fall within the Department’s scoring system and as a result their claim is thrown out of court?”
